FCC Warns Landowner Over Unauthorized Broadcasts on Its Property

The FCC’s Enforcement Bureau issued a Notice of Illegal Pirate Radio Broadcasting to a Virginia property owner in Williamsburg, VA.  The Enforcement Bureau’s Columbia Office investigated the property after receiving a complaint about unlicensed FM broadcasts on 99.5 MHz.  On two separate occasions, April 1 and July 17, 2025, agents used direction-finding equipment to confirm that the transmissions were emanating from a restaurant located on the property.

FCC records indicated that no license had been issued for a broadcast station operating on 99.5 MHz at that location.  The Enforcement Bureau also determined that the transmissions exceeded the power limits permitted for unlicensed operation under Part 15 of its Rules.

Under the Preventing Illegal Radio Abuse Through Enforcement Act (the PIRATE Act), the FCC has the authority to impose substantial fines not only on the individuals directly responsible for unauthorized broadcasting, but also on property owners who knowingly and willfully allow such activity to take place on their premises.  The Notice warned the property owner that it could face penalties of up to $2,453,218 if the FCC determined that it continued to permit unauthorized pirate radio broadcasts from its property.

The Notice directs the property owner to respond to the FCC within ten business days and provide evidence that the unlicensed pirate radio broadcasts have ceased.  The Notice also requires the property owner to identify the individual(s) responsible for the pirate operation.  Finally, the Notice informs the property owner that a failure to respond may be treated as evidence of knowledge and consent to the illegal broadcasts for purposes of initiating subsequent FCC enforcement proceedings involving “significant financial penalties” against the landowner.

Public Media Organization Resolves False EAS Tone Violations With $86,400 Consent Decree

The FCC’s Enforcement Bureau entered into a Consent Decree with a public media organization to resolve an investigation into the unauthorized transmission of Emergency Alert System (EAS) tones.  According to the Consent Decree, the organization distributed a program that included actual or simulated EAS tones to its 46 owned radio stations and approximately 500 affiliated stations, triggering violations of Sections 11.31 and 11.45 of the FCC’s Rules.  The Consent Decree includes an $86,400 civil penalty and a multi-part compliance plan.

The EAS is a national public warning system designed to deliver critical emergency information to the public, including weather alerts and AMBER alerts.  To preserve the integrity of emergency alerts, EAS tones may only be aired for specific uses, such as actual emergencies, authorized tests, and qualifying public service announcements (PSAs).  Section 11.45 of the FCC’s Rules strictly prohibits airing EAS tones or simulations thereof unless they are aired in connection with one of these uses.  The concern is that misuse of EAS tones will lead to accidental system triggers or the public becoming desensitized to the alert tones in an actual emergency, both of which threaten the effectiveness of the alerting system. On Thursday, August 7, the Federal Communications Commission (“FCC” or “Commission”) held its monthly Open Meeting, where it considered items spanning several industries, including broadcasting, satellite communications, and public safety, among others.  The expansive agenda reflected the Commission’s full court press on agency-wide regulatory streamlining, system modernization, and expansion of nationwide connectivity initiatives.  Below are high-level summaries of the items the Commission considered and adopted as part of the August meeting:

NEPA Review Modernization

The Commission adopted a Notice of Proposed Rulemaking (NPRM) to re-examine its environmental review procedures in accordance with the National Environmental Policy Act (NEPA) as amended in 2023, and to ensure such procedures are clear, facilitate greater and faster infrastructure deployment, and accelerate the federal permitting process.  To advance these objectives, the NPRM seeks comment on whether and how to revise the FCC’s rules to align with the updated definition of a “major federal action,” update or replace the Commission’s longstanding categorical exclusions, and streamline review timelines for environmental assessments and impact statements.  The NPRM further inquires whether geographic-area licenses and other Commission actions should trigger NEPA obligations and seeks comment on  proposed changes to related rules under the National Historic Preservation Act.

  • Comments on the NPRM are due by September 18, 2025; Reply Comments are due by October 3, 2025.

Streamlining Space Bureau Reviews

The Commission adopted a Second Report and Order (Order) in its Expediting Initial Processing of Satellite and Earth Station Applications proceeding, which focuses on further expediting processing of applications and removing certain regulatory barriers to modifying systems following authorization.  The Order facilitates the expansion of ground station as a service (GSaaS) by allowing operators to apply for baseline earth station licenses without pre-identified satellite points of communication and by streamlining the process by which operators can add or remove satellite points of communication to an existing earth station authorization.  Significantly, the Order also expands the types of modifications that will not require prior FCC approval, giving more post-authorization flexibility to space and earth station operators.  The Order also eliminates the paper copy retention rule, aligns renewal timelines across earth stations, geostationary, and non-geostationary satellite applications, adds a 30-day shot clock for certain renewals, and permits market access grantees to request special temporary access.

  • Except for those rules subject to the Paperwork Reduction Act, the Order will become effective on September 26, 2025.

The FCC’s rules require that all Emergency Alert System (EAS) Participants update their identifying information in the EAS Test Reporting System (ETRS) annually.  Accordingly, the FCC has released a Public Notice announcing that the deadline for updating and submitting the ETRS Form One for 2025 will be Friday, October 3, 2025.

For broadcasters, EAS Participants include full power radio and TV broadcast stations, including Class D noncommercial educational FM stations, and low power FM stations, program-originating FM booster stations, and low power TV stations that are not operating as TV translators.  Stations must file a Form One even if they are silent pursuant to a grant of Special Temporary Authority.

The following types of stations are exempt from this filing requirement:

  • TV translator stations
  • FM translator or booster stations that only rebroadcast the programming of a local radio station
  • Stations that operate as satellites or repeaters of a hub station (or of a common studio or control point if there is no hub station) which rebroadcast 100% of the programming of that hub station, common studio, or control point.  The hub station, common studio, or control point will still need to file its own Form One, however.

The Public Notice states that the Federal Emergency Management Agency will not be conducting a nationwide test this year, so stations will only be filing a Form One, and not a Form Two or Form Three, which are used when reporting on a national EAS test.  The last nationwide test was conducted nearly two years ago, on October 4, 2023. Public File Violations by Washington State Television Licensee Yield $29,000 Consent Decree

In the course of processing license renewal applications for three Washington state television stations, the FCC’s Media Bureau noted that the applicant certified that all required documentation had been uploaded to the stations’ Public Inspection Files when required.  According to the Media Bureau, however, the licensee failed to timely upload 40 Quarterly Issues/Programs Lists.

Section 73.3526(e)(11)(i) of the FCC’s Rules requires that every full power commercial television station place in its Public Inspection File “a list of programs that have provided the station’s most significant treatment of community issues during the preceding three month period.”  The list must include a brief narrative of the issues addressed, as well as the date, time, duration, and title of each program aired that addressed those issues.  The list must be placed in the Public Inspection File within 10 days of the end of each calendar quarter.

The Media Bureau noted that the Washington stations had failed to upload some quarterly lists at all, and many others had been uploaded late.  With regard to the licensee’s Spokane station, the FCC stated that three of the lists created during the license term were uploaded more than one year late. Its Richland station uploaded seven lists more than one year late, six lists between one month and one year late, and three lists under one month late. Lastly, its Yakima station uploaded nine lists over one year late, seven lists between one month and one year late, and five lists under one month late.

Compliance with the FCC’s rules requires that all reports be timely uploaded and that any failure to do so be disclosed in making the relevant certification in a station’s license renewal application.  At the request of the FCC, the licensee uploaded the lists that were entirely missing from the stations’ Public Inspection Files and amended the stations’ license renewal applications to change its certifications that “the documentation, required by 47 C.F.R. Section 73.3526 … has been uploaded to the station’s public inspection file when required” from a “Yes” response to a “No.”  The licensee also included attachments in the amendments disclosing the lists that were filed late. All in the Family: Unauthorized Oregon Station Transfers Between Mother, Daughter, and Sisters Result in Consent Decree and $16,000 Civil Penalty

The licensee of an Oregon AM station and its companion FM translator entered into a Consent Decree with the FCC’s Media Bureau to resolve the Bureau’s investigation into unauthorized transfers of control of the stations.  The Consent Decree follows a September 2024 Notice of Apparent Liability for Forfeiture (NAL) and requires the licensee to pay a $16,000 civil penalty.

Under Section 310(d) of the Communications Act and Section 73.3540 of the FCC’s Rules, voluntary transfers of control of a broadcast license require prior approval by the FCC.  To determine whether control of a broadcast license has changed, the FCC considers “actual or legal control, direct or indirect control, negative or affirmative control, and de facto as well as de jure control.”  An analysis of de facto control, which is analyzed by the FCC under a totality of the circumstances test, looks at, among other things, the exercise of control over a station’s programming, personnel, and finances.  Surrendering control over programming, personnel, or finances transfers de facto control of a station.  The de facto control analysis also considers whether the other person or entity in question has held itself out to the public, the station staff, or both as being in control of the station.

In 2014, the sole member of the licensee LLC entered into a purchase agreement to sell the station to her daughter.  The agreement stipulated that the daughter would pay the purchase price through “sweat equity,” defined by the parties as providing accounting and administrative services.  Between September 2016 and February 2021, the daughter delivered enough “sweat equity” services to satisfy the purchase price, after which the licensee LLC filed Articles of Organization with Oregon listing the daughter as the sole member/manager of the licensee LLC.

In October 2021, the mother and daughter amended the purchase agreement to acknowledge that the daughter had fully performed under the agreement, but that “the purpose of the Purchase Agreement has been frustrated by the mutual mistake of the Parties, who acknowledge that the sale and transfer of the FCC licensee and the Station[s’] FCC license[s] should have been subject to the prior approval by the FCC in accordance with 47 U.S.C. § 310 and regulations promulgated thereunder.”  The amendment stated that transfer applications would be filed within ten business days of execution of the purchase agreement amendment, but the applications were not filed until February 2022. FCC Proposes $146,976 Fine Against National Cable Sports Network for Transmitting False EAS Tones

The Federal Communications Commission issued a Notice of Apparent Liability for Forfeiture (NAL) to a cable sports network for violating the Commission’s Emergency Alert System (EAS) rules.  Specifically, the NAL alleged violations of Section 11.45 of the FCC’s Rules, which prohibits the transmission of false or deceptive EAS tones.

The EAS is a nationwide public warning system designed to alert the public in case of emergencies, such as severe weather warnings or AMBER alerts.  To maintain the effectiveness of such emergency alerts, EAS tones may only be aired for specific uses, such as actual emergencies, authorized tests, and qualified public service announcements (PSAs).  Section 11.45 strictly prohibits airing an EAS tone, or simulations of it, except in connection with these permitted uses.  The FCC takes false EAS tone violations particularly seriously, asserting that violations desensitize the public to legitimate EAS alerts.

In October 2023, the FCC received complaints alleging a cable network had transmitted EAS tones during a sports promotional video.  In January 2024, the Commission’s Enforcement Bureau sent a Letter of Inquiry requesting information about the incident.  The network responded, providing video recordings of the sports-related promo video that had aired for three days and admitting that it contained an EAS tone.  While the network argued the promo video contained fewer than two seconds of EAS tone, it did acknowledge that the tone was not aired in connection with an actual emergency, authorized test, qualified PSA, or other permitted use.  The network also acknowledged that the promo video aired six times over three days on two different networks.

Based on the network’s admissions and the FCC’s review of the video, the FCC found six apparent violations of Section 11.45 of the Commission’s Rules.  The FCC noted that while the two-second duration was shorter than a full EAS tone, it was long enough for viewers to recognize the sound as an EAS tone. Following the devastation wrought by Hurricane Helene across the American southeast and in anticipation of Hurricane Milton’s arrival, the FCC has announced an extension of the deadline to upload Third Quarter Issues/Programs Lists for radio and television stations in states particularly affected by Hurricane Helene (note that the Public Notice mistakenly refers to them as “first quarter” Lists) .  As discussed in our Third Quarter Issues/Programs List advisory, the Lists are due for most stations by October 10, 2024.  However, in light of the Commission’s announcement today, broadcast stations in Florida, Georgia, North Carolina, South Carolina and Tennessee now have until November 10, 2024 to upload these lists (the Public Notice actually says the October 10, 2020 deadline is extended to November 10, 2020, but the FCC’s intent is clear).

Because of Hurricane Helene, the FCC previously extended the deadline for broadcast stations nationwide (as well as all other EAS Participants) to file their Form One  in the EAS Test Reporting System.  The Form One, previously due on October 4, 2024, is now due on October 18, 2024.

In granting the latest extension only to stations in hurricane-impacted states, the FCC still encouraged those stations “to file their quarterly issues/programs lists as soon as practicable.”  The FCC also made clear that the extension “does not modify any requirements or filing deadlines related to stations’ political files, nor does it modify any other filing obligations or deadline related to broadcasters’ public files.”

Lastly, some practical advice—stations taking advantage of the Third Quarter Issues/Programs List extension should note in their upload file that they are filing after the normal deadline pursuant to an extension granted by the FCC.  When a station’s license comes up for renewal several years from now, and the licensee must certify that the Public File has been complete at all times, station employees may have forgotten why this particular filing appears to have been uploaded late.  It will be important for the station to have a contemporaneous note in the Public File explaining that the filing was not late, both to remind the licensee making its license renewal certification and to alert third parties and any FCC staff later reviewing the Public File that the List was in fact timely uploaded.

While the FCC often ties the deadline for filing the annual Form One to the occurrence of a nationwide EAS test, the Federal Emergency Management Agency and FCC have not announced a national test this year.  As a result, the Form One must be filed independently to satisfy the annual filing obligation.  The most recent nationwide test was held October 4, 2023.  That test was largely successful, with nearly 97 percent of EAS Participants receiving the test message and about 94 percent of Participants successfully relaying the message.  These numbers represent a seven percent increase over the receipt and relay success rates reported for the 2021 test (the last nationwide test conducted prior to 2023).

Form One filers should review the FCC’s Public Notice concerning this filing requirement, as well as the FCC’s ETRS Form One Filing Guide and Frequently Asked Questions for information about using the ETRS, and consult their state’s EAS Plan before responding to the EAS operational area and monitoring assignments prompts.

Filers should be sure to have on hand the FCC username and password associated with the FCC Registration Number(s) (FRN) of the entity(ies) for which they are filing.  Users who have not previously created a username may do so by visiting the User Registration System.  Filers should visit the main ETRS page to file their Form One in advance of the October 4 deadline in case they encounter any filing portal errors and need time to resolve them before the deadline.

The FCC’s Public Safety & Homeland Security Bureau has announced that technical updates to the EAS Test Reporting System (“ETRS”) have been completed and the ETRS is open and available to accept filings of Form One by EAS participants. Under the FCC’s EAS Rules, EAS participants must update their identifying information annually via a Form One filing. This is typically done in connection with a nationwide EAS test. However, the Federal Emergency Management Agency did not conduct such a test in 2022, and has not yet announced a 2023 nationwide test. Therefore, the Form One must be submitted independently of a test to comply with the annual updating requirement.

All broadcasters are generally required to submit a Form One, including low power FM stations, Class D noncommercial educational FM stations, and stations that are silent pursuant to a grant of Special Temporary Authority. Certain broadcasters are exempt from filing a Form One, including:

  • TV translator stations;
  • FM booster stations;
  • FM translator stations that entirely rebroadcast the programming of other local FM broadcast stations; and
